Terms of Use (AGB) for the "WECARE" Platform

1. Acceptance of Terms
By accessing or using the WeCare Platform ("Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.
2. Description of Service
WeCare is a platform that connects individuals seeking care services ("Care Seekers") with qualified care providers ("Caregivers"). WeCare acts solely as an intermediary and is not itself a care service provider. We do not employ caregivers and are not responsible for the conduct of any user on or off the Platform.
3. User Accounts
To use certain features of the Platform you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.
4. Eligibility
You must be at least 18 years of age to use the Platform. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
5. User Conduct
You agree not to use the Platform to: post false, inaccurate, misleading, defamatory, or offensive content; harass, abuse, or harm another person; impersonate any person or entity; violate any applicable laws or regulations; transmit any viruses or malicious code; or collect or store personal data about other users without their consent.
6. Background Checks and Safety
WeCare may facilitate background checks on Caregivers as part of the registration process. However, we do not guarantee the accuracy of background check results and cannot guarantee the character or qualifications of any user. Care Seekers are solely responsible for verifying the suitability of any Caregiver they engage.
7. Payments and Fees
WeCare may charge fees for certain features or services. All fees are stated in EUR and are inclusive of applicable taxes unless otherwise stated. Payments between Care Seekers and Caregivers are facilitated through our payment processor. WeCare is not responsible for disputes regarding payment between users.
8. Intellectual Property
The Platform and its original content, features, and functionality are and will remain the exclusive property of WeCare and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of WeCare.
9. Disclaimers and Limitation of Liability
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. WeCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.
10. Indemnification
You agree to defend, indemnify, and hold harmless WeCare and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.
11. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any significant changes by updating the effective date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
